RÉCLAMATION VOL EN RETARD INC. / LATE FLIGHT CLAIM INC. (la « Société ») est une société en multidisciplinarité constituée sous la Loi canadienne sur les sociétés par actions, ayant son siège social au 6300, Ave. Auteuil, bureau 230 Brossard (Québec), J4Z 3P2, soumise au Règlement sur l’exercice de la profession d’avocat en société et en multidisciplinarité, dûment inscrite auprès du Barreau du Québec, regroupant plusieurs professionnels régis par le Code des professions du Québec (L.R.Q., c. C-26). Par l'entremise de ses avocats, membres inscrits au Barreau du Québec, la Société offre des services juridiques relativement aux transports aériens. La Société est également dûment inscrite au Registraire des entreprises du Québec et porte le numéro d'entreprise du Québec (NEQ) 1171974059.  M^e Michael Cheng, est avocate et dûment inscrite au Barreau du Québec. La Société et M^e Michael Cheng, étant collectivement ci-après désignés comme étant les « Mandataires ».

RÉCLAMATION VOL EN RETARD INC. / LATE FLIGHT CLAIM INC. (the “Corporation”) is a corporation incorporated under the Canada Business Corporations Act having its head office at 6300, Ave. Auteuil, bureau 230 Brossard (Québec), J4Z 3P2, and operating in a multidisciplinary structure under the Règlement sur l’exercice de la profession d’avocat en société et en multidisciplinarité and registered with the Quebec Bar (Barreau du Quebec). The Corporation is composed of several professionals governed by the Quebec Professional Code. Through its Attorneys at Law, who are duly registered with the Quebec Bar (Barreau du Québec), the Corporation offers legal services relating to air transportation. The Corporation is also duly registered with the Québec Enterprise Registrar (Registraire des entreprises du Québec) (NEQ number: 1171974059). M^e Michael Cheng is an Attorney at Law duly registered with the Québec Bar (Barreau du Québec). The Corporation and M^e Michael Cheng, being collectively hereinafter referred to as the "Mandatary".

Par les présentes, agissant pour son enfant étant mineur () (ci-après le « Client ») autorise les Mandataires à le conseiller, l’assister, et à le représenter si la Société l’estime nécessaire, afin de faire valoir ses droits (ci-après la « Procuration ») en vertu du Règlement (CE) N° 261/2004 et/ou la Convention de Montréal et/ou le contrat de transport aérien et/ou le règlement canadien intitulé Règlement sur la protection des droits des passagers aériens ou autres, le cas échéant (ci-après la « Réclamation ») vis-à-vis du transporteur aérien (ci-après la « Compagnie Aérienne »), et ce, dans toutes les communications, écrites ou verbales, qui pourraient intervenir entre lui et la Compagnie Aérienne durant tout le processus de la Réclamation.  Pour ce faire, le Client autorise les Mandataires, en son nom, à recevoir, rédiger et transmettre l'ensemble des déclarations nécessaires au processus de Réclamation.

Le Client autorise également les Mandataires, lorsque cela est possible, à procéder au recouvrement de sa créance envers la Compagnie Aérienne, dans le cadre extra-judiciaire. Pour ce faire, la présente Procuration s'étend également à la réception de paiements en espèces par les Mandataires pour le compte du Client.

Les Mandataires sont donc autorisés, par le Client, à entreprendre et à faire valoir toutes les mesures de recouvrement extra-judiciaire nécessaires envers la Compagnie Aérienne, jusqu'à la réception du paiement d’indemnisation découlant de la Réclamation du Client en son nom et payable à RÉCLAMATION VOL EN RETARD INC. en fidéicommis.

Dans le cas où les Mandataires ont perçu le paiement au nom du Client, à la suite de la réception du paiement de l’indemnisation effectué par la Compagnie Aérienne, les Mandataires s'engagent à remettre au Client toute somme lui revenant selon les termes prévus aux Conditions générales (« Termes et conditions ») de Réclamation vol en retard inc. acceptées préalablement par le Client.

Par les présentes, les Mandataires, acceptent le contrat de services et/ou le mandat qui leur est confié par le Client et s'engagent à l'accomplir dans le respect des limites prévues et mentionnées à la présente Procuration, et à tous autres documents contractuels régissant la relation entre la Société et le Client.

acting for his/her child () (hereinafter the ''Client'') hereby instructs the Mandatary to advise, to assist, and to represent him if the Corporation deems it necessary,  for the enforcement of  his rights (hereinafter the ''Power of Attorney'') pursuant to Regulation (CE) N° 261/2004 and/or the Montreal Convention and /or the Air Transport Agreement and/or the Canadian regulation named Air Passengers' Protection Regulation and others as appropriate (hereinafter the ''Claim'') towards (hereinafter referred to as ''Airline'') in all communications, of whether written or verbal nature, which may occur between him and the Airline during the entire process of the Claim. To that end, the Client authorizes the Mandatary to receive, draft and transmit on his behalf all declarations deemed necessary to ensure the due course of the Claim process.

The Client further authorizes the Mandatary, if possible, to proceed with the recovery of his claim against the Airline, in an extra-judicial framework. To this end, this Power of Attorney further extends to the receipt of cash payments by the Mandatary on behalf of the Client.

The Mandatary is therefore authorized by the Client, on his behalf, to undertake and enforce all necessary collection measures in an extra judicial framework against the Airline, including the receipt of the compensation payment arising from the Claim payable to LATE FLIGHT CLAIM INC. in Trust.

In case the Mandatary has collected the compensation payment on behalf of the Client, following the receipt of said payment, the Mandatary undertakes to remit to the Client any sum due to him in accordance with the terms provided for in the Terms and Conditions of Réclamation Vol En Retard inc. previously accepted by the Client.

The Mandatary hereby accepts the service contract and/or the mandate entrusted to them by the Client and undertake to fulfill it within the limits provided for and referred to in this Power of Attorney.
