What the law says about flight delay compensation

When departing from Canada, there is still no obligation for most of the airlines to provide passengers flight delay compensation. Airlines generally don’t offer monetary flight delay compensation in Canada and instead offer passengers meal vouchers, etc. Each dispute that arises with regard to flight delay compensation in Canada is therefore handled on a case-by-case basis.

In the event of a delayed flight from the United States or Europe, all airlines must comply with the regulations in effect in those places pertaining to EU flight delay compensation and in USA denied boarding compensation.

What the law says in Europe and the United States regarding flight delay compensation

For any flights from Europe and for all flights to Europe with a community carrier, Regulation (EC) No. 261/2004 specifies that, for any delay of over three hours, EU flight delay compensation of up to 600 Euros (around $900) must be paid to each affected passenger, subject to the exceptions provide by the regulation.

The EU flight compensation amount is calculated based on the distance of your flight as well as the duration of the delay. This regulation applies to EU flight delay compensation packages for all airlines departing from the European Union. Flights heading to the European Union require airlines that are from the EU.

The regulation also requires that a written document outlining the EU flight delay compensation amounts be submitted to travellers in the event of a delay of over two hours.

In the United States, the law from 2009 regarding flight delay compensation US is different: any delay of more than one hour caused by overbooking entitles travellers to flight delay compensation in an equivalent amount, or to a higher flight delay compensation in vouchers, as well as a detailed written explanation of this compensation.

A concrete example

After a trip to London, you wait eight hours at the airport before the flight finally takes off. As EU flight delay compensation, the airline generously offers you a $100 credit on your next ticket. Upon returning to Canada, however, you learn that, in fact, the law authorized you to claim and collect flight delay compensation in the amount of 600 Euros, or nearly $900… What do you do? Who do you turn to? Is it too late?

Good to know

A passenger’s bill of rights pertaining to EU flight compensation has existed in Europe since 2005.  Likewise, a passenger’s bill of rights has been in place in the United States since 2009 that deals with flight delay compensation in the US. This type of agreement addressing flight delay compensation in Canada is not yet in place in Canada, which means that airlines are free to follow their own rules within the context of the Flight Rights Canada initiative established in 2008 with regard to how they reward flight compensation in Canada.
